The Complete Georgia Eviction Process
Georgia's Dispossessory Proceeding follows strict legal requirements. Here's exactly how the process works and how we guide you through each step.
Demand for Possession Notice
Day 1-3Georgia law requires landlords to provide written notice before filing. For non-payment, this notice demands rent or possession. We prepare and serve compliant notices that meet all legal requirements.
Dispossessory Affidavit Filing
Day 4-7After the notice period, we file the Dispossessory Affidavit with the Magistrate Court. This formally initiates the eviction case and must include all required documentation.
Tenant Service of Process
Day 8-14The court issues a summons that must be properly served to the tenant. Georgia requires personal service or tack-and-mail service. Our private process servers handle service quickly and compliantly.
Tenant Answer Period
7 Days from ServiceTenants have 7 days from service to file an answer with the court. If they answer, a hearing is scheduled. If no answer, you may proceed to default judgment. We monitor and prepare for both scenarios.
Court Hearing
14-21 DaysIf the tenant answers, both parties appear before the Magistrate Judge. We prepare your case presentation, organize evidence, and provide clear guidance on what to say and expect in court.
Judgment & Writ of Possession
Day of JudgmentUpon favorable judgment, we immediately file for the Writ of Possession. This authorizes the Marshal/Sheriff to remove the tenant. Timing is critical—delays cost you rent.
Set-Out Execution
7-14 Days Post-WritThe Marshal/Sheriff executes the Writ, physically removing the tenant and belongings if necessary. We coordinate the entire set-out process, including crews and property securing.
